These Terms of Use (“Terms”) govern your access to and use of the PSI Hydraulics website, including its pages, content, forms, file-upload features, blog-comment features, and related online services (collectively, the “Website”).
By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.
“PSI,” “we,” “us,” and “our” refer to PSI Hydraulics.

Products and services are governed by the applicable quotation, work order, order acknowledgment, written agreement, and PSI’s Terms and Conditions of Sale and Service.

You may use the Website only for lawful purposes and in accordance with these Terms.
You may view, download, or print reasonable portions of publicly available Website content for your own legitimate, noncommercial informational use, provided you do not remove copyright, trademark, or proprietary notices.

Internet and email communications are not guaranteed to be secure. Do not submit Social Security numbers, payment-card data, bank-account information, medical information, passwords, export-controlled information, or other highly sensitive information through a general Website form.
6. File, Drawing, and Photograph Uploads
You may upload drawings, photographs, specifications, and other project-related files only when you have the legal right and authority to do so.
By uploading material, you represent that:

Your submission does not violate another party’s intellectual-property, confidentiality, privacy, contractual, or other rights;

The material does not contain malicious code; and

PSI may review and use it to evaluate and respond to your request.
You grant PSI a nonexclusive, worldwide, royalty-free license to host, copy, reproduce, modify, transmit, and share uploaded material with PSI personnel, contractors, suppliers, and service providers as reasonably necessary to review your request, prepare a quotation, communicate with you, or provide requested products or services.
You retain your ownership rights in submitted material. This license does not authorize PSI to publish confidential project materials for unrelated marketing purposes.
You should retain your own copies. The Website is not an archival or backup service.
7. Blog Comments and Public Submissions
Comments submitted to public portions of the Website may be visible to other visitors. Do not include confidential information, personal contact information, sensitive personal information, or material you do not want disclosed publicly.
By posting a public comment, you grant PSI a nonexclusive, worldwide, royalty-free license to host, reproduce, display, format, moderate, and distribute the comment in connection with the Website and PSI’s business communications.
PSI may review, edit, decline, hide, or remove comments at its discretion, including comments that are off-topic, abusive, misleading, promotional, unlawful, infringing, or potentially harmful. PSI is not obligated to monitor or retain comments.
The opinions expressed by visitors are their own and do not necessarily represent PSI.
8. Employment Applications
Employment information on the Website is not a promise of employment or continued availability of a position.
Applicants must provide truthful and complete information. PSI may verify application information and request additional documentation as permitted by law.
Submission of an application does not create an employment contract or guarantee an interview, offer, or response. Employment decisions are made according to PSI’s business needs and applicable law.

The Website and its original text, design, layout, graphics, photographs, videos, logos, trademarks, service marks, software, and other content are owned by PSI or used with permission and are protected by intellectual-property laws.
Except for the limited permission expressly granted in these Terms, no right or license is granted to use PSI’s names, logos, marks, copyrighted content, designs, or other intellectual property.
Third-party names, logos, and marks belong to their respective owners.
10. Accuracy and Availability
PSI makes reasonable efforts to provide useful and current information but does not warrant that Website content is complete, accurate, current, or suitable for a particular purpose.
Product specifications, availability, services, photographs, descriptions, and other Website content may change without notice. Images may be illustrative and may not represent an exact product or configuration.
PSI may modify, suspend, restrict, or discontinue any portion of the Website at any time.

The Website may contain links to or embedded content from third parties, including Google Maps, YouTube, social-media platforms, and other providers.
Third-party services are governed by their own terms and privacy practices. PSI does not control and is not responsible for third-party content, availability, security, products, statements, or practices. 12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND.
PSI DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, SECURITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
PSI DOES NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF HARMFUL COMPONENTS, OR COMPATIBLE WITH EVERY DEVICE OR BROWSER.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSI AND ITS OWNERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE WEBSITE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PSI’S TOTAL LIABILITY FOR A CLAIM RELATING SOLELY TO USE OF THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
These limitations do not apply to liability that cannot legally be limited or excluded.
14. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PSI and its owners, employees, representatives, contractors, and service providers from third-party claims and reasonable expenses arising from your unlawful use of the Website, content you submit, your infringement of another party’s rights, or your material breach of these Terms.
15. Suspension or Termination
PSI may restrict or terminate your access to the Website if PSI reasonably believes you have violated these Terms, created a security risk, infringed another party’s rights, or used the Website unlawfully.
Provisions that by their nature should survive termination will remain in effect.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceeding concerning the Website or these Terms must be brought in a state or federal court having jurisdiction in or over Waller County, Texas, unless applicable law requires otherwise.
17. Changes to These Terms
PSI may update these Terms periodically. The revised Terms become effective when posted with an updated “Last Updated” date.
Your continued use of the Website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
18. General Provisions
If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect.
PSI’s failure to enforce a provision is not a waiver of its right to enforce it later.
These Terms, together with the Privacy Policy and Cookie Policy, constitute the agreement governing use of the Website.
